Terms of Service

These Terms of Service ("Terms") govern your use of the Protein Pricer mobile application ("the App") operated by Hira Kashta, LLC ("we", "us", "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Protein Pricer is a mobile application that allows users to scan product barcodes, calculate the price per gram of protein, and compare value across stores using a community-driven pricing database. The App is provided free of charge.

3. Accounts

The App is fully functional without creating an account. If you choose to create an account (via email or Apple Sign In), you are responsible for maintaining the security of your credentials. You agree to provide accurate information and to notify us if you suspect unauthorized access to your account.

You may delete your account at any time from the Account screen in the App. Deleting your account permanently removes your personal data and associated scan records from our servers.

4. User Contributions

When you save a scan, the pricing data (product name, barcode, price, store name, calculated values) is uploaded to our shared database and made available to other users. By saving a scan, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute this pricing data as part of the community database.

You agree that your contributions:

• Represent genuine pricing observations from real products and stores.
• Do not contain offensive, misleading, or fraudulent information.
• Do not infringe on any third party's intellectual property rights.

We reserve the right to remove any contributions that violate these Terms.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or spam data to the shared database.
• Attempt to circumvent rate limits or other security measures.
• Use the App to harass, abuse, or harm others.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use automated tools, scripts, or bots to interact with the App or its database.
• Interfere with or disrupt the App's infrastructure or other users' experience.

6. Accuracy of Information

Product nutrition data is sourced from Open Food Facts, an open, community-driven database. While we strive to display accurate information, we do not guarantee the accuracy, completeness, or reliability of any product data, nutrition information, or pricing data displayed in the App.

The App is not a substitute for reading product labels. Always verify nutrition information on the actual product packaging, especially if you have dietary restrictions, food allergies, or medical conditions.

Pricing data in the community database is contributed by users and may be outdated, incorrect, or not applicable to your location. We are not responsible for purchasing decisions made based on information in the App.

7. Intellectual Property

The App, its design, code, and branding are the property of Hira Kashta, LLC. Product data is sourced from Open Food Facts under the Open Database License (ODbL). Community pricing data is licensed for use within the App's shared database as described in Section 4.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Hira Kashta, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid to use the App (which is zero, as the App is free).

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the App at any time. If you have an account, you may delete it from the Account screen.

11. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page will be updated accordingly. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.
